P&Z approves growth near Kroger, ponders fences

During its regular Jan. 04, 2018 meeting, the Forney Planning & Zoning Commission met and in summary:


  • Approved a site plan for Victory Shops at Forney 2, N. of U.S. 80 and west of Marketplace Boulevard.
    Mr. Morgan said last month the commission did one in front of Kroger, this is South of that, phase 2. Itis 2.36 acres, main building will be 17,115 sq ft. Parking is above what is required. Staff recommends approval.
    Mr. Wilkins asked what the use would be - about 50% each retail & restaurant.

  • Approved a final plat for the Prescott 741 Addition, located N. of I-20 and east of FM 741.
    Mr. Morgan said this is 1.3 acres, the plat is just to provide boundaries. It is next to Dollar General. Preliminary plat was approved by council in November. Mr. Morgan said as it is in the ETJ, they have no zoning control, can only approve civil engineering plans. Mr. Cunningham asks about the driveway needing TxDOT approval.

  • Approved a final plat for the Juan Aguinaga Office Addition, located east of Pinson Road (F.M. 740) and north of Redbud Drive.
    Mr. Morgan said this has been discussed multiple times, site plan was approved by council in June, staff finds it meets all requirements and recommends approval. The plans shows a fire lane stub to adjacent property.

  • Held Public Hearings -
    • Approved an amendment to the City of Forney Comprehensive Zoning Ordinance to add a definition and regulations for Intradermal Cosmetics (Permanent Makeup) to operate as an accessory use.
      Mr. Morgan said staff was contacted about providing this use, Texas State Health Services provides definitions and regulations for cosmetic tattoos. Staff found this is a popular and generally accepted use. Definition only allows for accessory use at barber/beauty shops, not for ornamental tattoos.
      Ms. Denise Bell asked about tattoo parlors - Mr. Morgan said they do have separate regulations for that, but tattoo parlors are very heavily regulated. They want to provide this use as an accessory, other beauty shops will be able to add this use, and some may already be doing it.
      The applicant/owner offered to answer questions, there were none. Ms. Lemons asked who will check that they don't do tattoos. Mr. Morgan said the fire marshal does annual inspections, and citizens could report it. Tattoo parlors generally want high visibility, the regulations make that difficult. Mr. Cunningham verified this would be allowed as service.
    • Approved with stipulations an Ordinance amending the City of Forney Comprehensive Zoning Ordinance to amend the requirements for fences.
      Mr. Morgan said at previous council meeting , Mr. McGee asked to require all fences have metal posts. Staff found that is a popular requirement, but they have other changes. Formalize not requiring a permit if < 50% being replaced.
