P&Z approved new ANB location, denies rental truck request

During its regular June 01, 2017 meeting, the Forney Planning & Zoning Commission met and (this is the preliminary report, subject to change):

  • Held Public Hearings -
    • Mr. Morgan stated two notes about the agenda: Fox Hollow item has been withdrawn, might come back in future; and Aguinaga Office did not actually need a zoning change.
    • Approved a request for approval of a Conditional Use Permit for Auto Repair (Major) to be an approved use to operate at 12201 Currency Circle.
      Mr. Morgan said this was in the south Mustang park PD, the business works on 18-wheeler transmissions, but there will be no storage or parking of 18-wheelers on site. There are heavier industrial uses in this district.
      There was no public input. Mr. Cunningham wanted to verify there will be no outside storage of parts or chemicals - Mr. Morgan said that is true. Ms. Coffman asked about language prohibiting vehicle storage - Mr. Morgan read the section related to that, and said it storage would also violate the base zoning.
    • Did NOT consider a request for approval of an amendment to the Fox Hollow South (Villages of Fox Hollow) Planned Development No. 1114, amended by Ordinance No. 1126, by amending the Planned Development Conditions and the Concept Plan to allow for the development of single-family residential lots at a minimum lot size of 9,000 square feet.
    • Denied a request for approval of a Conditional Use Permit for Truck Rental and ATV Dealer (Golf Carts) to be approved uses to operate at 10512 E. U.S. Highway 80, Forney, Texas. The property currently has an approved Conditional Use Permit for ATV Dealer (Golf Carts) only.
      Mr. Morgan stated the property was on Hwy 80, and staff recommends denial, as there is not suitable for truck storage, and city council has recently denied a request because of vehicle parking.
      There was no public input.
      Mr. Cross asked the applicant if they were required to have certain # vehicles on site - no more than 10, they have a verbal agreement with neighbor business to park 4 trucks. Mr. Rexrode asked what if that business changes? Applicant said there is still enough parking. Ms. Coffman mentioned the photographs of the rear of the building showed a lot of parts and debris, applicant said they are clearing it out. Mr. Cunningham said the pictures show them having 3 parking slots - applicant says there are 5, Mr. Cunningham said there isn't enough parking for the load he wants - applicant mentioned the parking next door, Mr. Cunningham asked Mr. Morgan about any standard shared parking agreements - there aren't any, the property owners create their own, one has not been presented for this.
      Chmn Wilcoxson said he wasn't comfortable with a verbal agreement
    • Tabled an amendment to the City of Forney Comprehensive Zoning Ordinance by amending Section 12 to amend the process for revising an approved site plan and concept plan.
      Mr. Morgan explained what sort of small changes staff would like to approve.
      There was no public input.
      Ms. Coffman asked about materials change; Mr. Morgan used stone trim as an example. She asked about sq. footage, Mr. Morgan said a 6,600 change to 6,555. Ms. Coffman said she would be more comfortable with a percentage definition. Mr. Morgan said 10% is a common value in zoning rules. She also mentioned a sentence about city council having sole discretion; Mr. Morgan said it could be removed. After some discussion, the board preferred to table it until next month.
    • Approved of a replat for Lot 3A, Block A, Ridgecrest Center, being a replat of Lot 3, Block A, Ridgecrest Center.
      Mr. Morgan said this is where a CUP was approved behind Aldis for a school.
      There was no public input.

  • Approved a site plan for Pinnacle Montessori of Forney, located west of F.M. 548 and south of Ridgecrest Road. (this is the same property as the replat)
    Mr. Patroski briefed the board, the property is currently vacant. The plan shows 15 stacking spaces and 66 parking spaces.
  • Approved a site plan for the Juan Aguinaga Office, located east of Pinson Road (F.M. 740) and Magnolia Drive.
    Mr. Patroski briefed the board, the property does have residential districts S. an E. separated by flood plain, plan shows 2,014 square foot office building that could potentially be separated into 3 separate suites, the driveway will align with Magnolia across Pinson.
    Mr. Cunningham asked how far from school the building would be; Mr. Patroski guessed 90 ft.
  • Approved a preliminary plat for Lakewood Trails Addition, a residential subdivision located south of F.M. 741 between High Country Lane and Walnut Lane.
    Mr. Morgan briefed the board on the location in the ETJ (it is "west" & "south" of the middle curve on 741 [between Windy Ln & 2932]) and the developer agreement approved by council in Dec. 2014, which includes 605 residential lots (SF-6), 9 common area lots, 1 school lot, and 1 Amenity Center lot.
    Chmn. Wilcoxson asked if the agreements go directly to council and not P&Z; correct. Mr. Rexrode asked if any changes had been made since original approval; Mr. Morgan said was a slight change to the entry features. Ms. Lemons asked if any changes has been made since the plat expired; Mr. Morgan said plats expire after one year, but the agreement does not. Chmn. Wilcoxson said they are basically required to approve they meet the requirements of the agreement; Mr. Morgan said yes, it is not a zoning issue. Ms. Coffman asked about having only one entry point; Mr. Morgan said there will be a second one, the Fire Marshall will require it. There may be a stub that could connect to Monitor Blvd.
  • Approved in one motion:

    • a preliminary plat for Lots 1 & 2, Block A, City Plaza Phase III, located south of U.S. Highway 80 and east of Regal Drive.
      Mr. Morgan stated the next 3 items are related.
    • a final plat for Lots 1 & 2, Block A, City Plaza Phase III, located south of U.S. Highway 80 and east of Regal Drive.
      Chmn. Wilcoxson asked if there would be 2 American National Banks; Mr. Morgan did not know. Mr. Cunningham asked if this was next to what will be Christian Brothers; yes.
    • a site plan for American National Bank of Texas, located south of U.S. Highway 80 and east of Regal Drive.
